These Terms & Conditions (“Terms”) constitute a legally binding agreement between: Ekatraa Assistance Private Limited (“Ekatraa”) AND You (“User”).

By accessing, registering, or using the Platform (mobile app/website), you:

• Agree to be bound by these Terms
• Confirm that you are legally competent under the Indian Contract Act, 1872
• Provide valid consent under the Information Technology Act, 2000

2.1 Ekatraa is not an event management company and does not provide any event-related services.

2.2 Ekatraa operates solely as a technology intermediary platform facilitating connections between Users and independent third-party vendors (“Vendors”).

2.3 All services are provided by Vendors and are not owned, controlled, or managed by Ekatraa.

Ekatraa qualifies as an “Intermediary” under the Information Technology Act, 2000 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

Accordingly:

• Ekatraa does not initiate or control service transactions
• Is entitled to safe harbour protections

To use the Platform, you represent that you:

• Are at least 18 years of age
• Are legally capable of entering into a binding contract under applicable law
• Will provide accurate, current, and complete registration information
• Are not barred from using the Platform under any applicable law

• You are responsible for maintaining the confidentiality of your login credentials
• You are solely responsible for all activity that occurs under your account
• You must promptly notify us of any unauthorised use

We reserve the right to suspend or terminate accounts for violations of these Terms. Ekatraa shall not be liable for unauthorized account usage.

6.1 Bookings are confirmed only upon payment of advance (minimum 20%).

• All payments are processed through the Platform's designated payment gateway
• You agree to pay all fees, service charges, and applicable taxes at the time of booking
• Payments made to the Platform do not guarantee service performance by the vendor
• Any disputes relating to payment must be raised within 7 days of the transaction
• We reserve the right to modify fee structures with prior notice

6.2 Ekatraa facilitates payments but does not guarantee vendor availability or service quality.

6.3 When you book a service through the Platform:

• You enter a direct contract with the vendor — not with Ekatraa
• You agree to the vendor's specific service terms, pricing, and cancellation policy
• You must review vendor profiles, ratings, and service descriptions carefully before booking
• All bookings are subject to vendor availability and acceptance
• A confirmed booking constitutes your binding agreement with the vendor

7.1 Advance payments are non-refundable unless Booking Protection is opted.

• Cancellation and refund policies are set by individual vendors and displayed on their profiles
• Platform convenience fees are non-refundable unless stated otherwise
• In cases of vendor no-show or fraud, you may raise a dispute through our support channel
• Refunds, if applicable, will be processed within 7–14 business days to your original payment method

7.2 Refunds under Booking Protection are governed by Platform-defined refund slabs and vendor commitments.

7.3 Rescheduling is subject to vendor availability and applicable charges.

8.1 Ekatraa does not sell, supply, or distribute alcohol.

8.2 Alcohol-related services (if any) are provided solely by licensed Vendors and governed by the Odisha Excise Act, 2008 and its applicable rules.

8.3 Users agree to:

• Provide valid ID proof
• Obtain necessary permissions/licenses
• Comply with legal drinking age requirements

8.4 Ekatraa shall not be liable for illegal consumption, regulatory violations, or unauthorized procurement.

You agree not to:

• Post false, misleading, or defamatory reviews or content
• Use the Platform for any unlawful, fraudulent, or abusive purpose
• Attempt to contact or transact with vendors outside the Platform to circumvent fees
• Harass, threaten, or intimidate vendors or other users
• Reverse-engineer, copy, or misuse any part of the Platform

Violation may result in account suspension or termination.

10.1 Vendors are independent third parties.

10.2 Ekatraa does not control service execution, guarantee service quality, or assume responsibility for Vendor performance.

10.3 All disputes regarding services must be resolved between User and Vendor.

To the fullest extent permitted by law, Ekatraa shall not be liable for:

• Any direct, indirect, incidental, or consequential damages
• Service failures, delays, or defects
• Loss of data, profits, or business
• Personal injury or property damage

Ekatraa’s total liability shall be limited to Platform service fees (if any) paid for the transaction.

You agree to indemnify and hold harmless Ekatraa from any claims arising from your breach of these Terms, legal violations, misuse of the Platform, or disputes with Vendors.

Ekatraa shall not be liable for delays or failures due to government restrictions, natural disasters, emergencies, or law enforcement actions.

14.1 Ekatraa collects and processes data in accordance with the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023.

14.2 Data may be shared with Vendors for service fulfilment.

14.3 Users have rights to access data and request correction or deletion.

These Terms shall be governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts located in Odisha.
